ARTICLE 1 – SCOPE AND PURPOSE

These general conditions of distance selling (hereinafter "GTC") govern the contractual relationship between, on the one hand, Le restaurant Le Garage (site www.legarage-valdisere.com) - SARL LE VAL D'ISERE, located AV OLYMPIQUE in VAL D'ISERE (73150), secondary establishment of the company SARL LE VAL D'ISERE, registered in the trade and companies register under number: 076 920 479 ( hereinafter "The Garage") and, on the other hand, each customer (hereinafter the "Customer(s)") placing an order via the website at the address www.legarage-valdisere.com.

The fact of placing an order with Le Garage implies unreserved acceptance of these GCS by the Customer, to the exclusion of any other condition, except with the prior written consent of Le Garage. The T&Cs are available on the site.

The Garage reserves the right to adapt or modify these T&Cs at any time without notice. These changes are applicable and enforceable against the Customer from the time they are posted on the site and apply to any subsequent order. The version of the GCS applicable at the time the order is placed is available on the site.

ARTICLE 2 – WITHDRAWAL FROM A RESTAURANT 

The delivery of the order will take place at the delivery address indicated by the Customer when ordering.

All deliveries are made within the approximate time indicated when ordering on the site. The Garage makes its best efforts to respect them, but hazards (in particular related to bad weather, traffic, etc.) may lead to delivery times being exceeded, which cannot give rise to compensation.

If the Customer is not present to receive the delivery of the Products ordered at the address indicated during the order, it will be won and The Garage will not refund the price of the order and will invoice the Customer for the full amount.

If you choose to withdraw the order from a restaurant, it is only available from the Restaurant at the time indicated when ordering. In the event of a delay in the provision, the restaurant will contact the Customer by telephone.

ARTICLE 3 – RIGHT OF WITHDRAWAL 

The right of withdrawal does not apply to perishable products. Consequently, the Customer has no right of withdrawal and cannot return to his order once it has been registered by Le Garage. 

ARTICLE 4 – PRICE

The applicable prices are those in force at the time of the Customer's order, as displayed on the site.

They are expressed in euros all taxes included. They take into account the VAT applicable on the day of the order.

Any change in the VAT rate may be passed on to the prices of the Products.

ARTICLE 5 – CONFIDENTIALITY – PERSONAL DATA

The Garage implements all reasonable means to ensure the confidentiality and security of data transmitted on the web.

The conditions for processing the Customer's personal data, entered and recorded during the order are specified in the Legal Notice and General Conditions of Use (CGU) of the site which have contractual value and can be consulted on the following link: below.

All elements of the site, whether visual or audio, including the underlying technology, are protected by intellectual property rights and the Customer acknowledges that these rights are the exclusive property of Le Garage or its suppliers.

ARTICLE 6 – APPLICABLE LAW AND DISPUTE RESOLUTION

These T&Cs are governed by French law.

All disputes to which these general conditions of sale could give rise, concerning their validity, their interpretation, their execution, their consequences and their consequences will be submitted to the competent courts under the conditions of common law. In the event of a dispute with Professional Customers, the Commercial Court of Chambéry will have sole jurisdiction.

Consumers are invited to first submit their dispute with Le Garage which could not be resolved by mutual agreement to the mediation mechanism offered by the French Franchise Federation.
